Panorama Terms of Service

Last updated 29 October 2026

These Terms of Service (the “Terms”) form a binding legal agreement between you and Alper Kaplan (“we”, “us” or “our”), the developer and provider of the Panorama application for iPhone, iPad, Mac and Apple TV (“Panorama” or the “App”). By downloading, installing or using the App, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not download, install or use the App. Sections 15 (Disclaimer of Warranties), 16 (Limitation of Liability) and 17 (Indemnification) limit our liability and allocate risk to you, so please read them carefully.

1. Definitions

1.1  “App” or “Panorama” means the Panorama application, together with its updates, content and documentation.

1.2  “We”, “us” and “our” mean Alper Kaplan.

1.3  “You” and “your” mean the individual or entity using the App.

1.4  “Apple” means Apple Inc. and its subsidiaries.

1.5  “Content” means the photos, videos, albums and other materials you import, create or store in the App.

1.6  “Shared Album” means an album that you share, or that is shared with you, through iCloud sharing in the App.

2. Eligibility and acceptance

You may use the App only if you can form a binding contract with us and are not barred from doing so under applicable law. If you are under the age of majority in your place of residence, you may use the App only with the involvement and consent of a parent or legal guardian. By using the App you represent that you meet these requirements and that you will comply with the Apple Media Services Terms and Conditions.

3. Licence

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use the App for your own personal, non-commercial purposes on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions and Apple’s standard Licensed Application End User License Agreement (the “Standard EULA”).

4. Licence restrictions

Except to the extent applicable law prohibits these restrictions, you will not, and will not permit anyone else to:

4.1  copy, modify, adapt, translate or create derivative works of the App;

4.2  reverse engineer, decompile, disassemble or attempt to derive the source code of the App;

4.3  rent, lease, lend, sell, sublicense, distribute or otherwise transfer the App;

4.4  remove, obscure or alter any proprietary notices in the App;

4.5  use the App for any unlawful, infringing or harmful purpose, or in violation of these Terms; or

4.6  interfere with or disrupt the integrity or performance of the App.

5. Subscriptions, purchases and billing

The App offers paid plans, which are sold and processed by Apple through the App Store: auto-renewable subscriptions (billed monthly or yearly) and a one-time, non-consumable lifetime purchase. Current prices, and any free trial, are displayed in the App before purchase. One purchase unlocks the App on iPhone, iPad, Mac and Apple TV signed in with the same Apple Account.

5.1  Payment is charged to your Apple Account upon confirmation of purchase.

5.2  Auto-renewable subscriptions renew automatically for successive periods unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends, at the then-current price for the selected plan.

5.3  If a plan includes a free trial, you will not be charged if you cancel before the trial ends. When the trial ends, the subscription begins and is charged as described in Section 5.2. Any unused portion of a free trial is forfeited when you purchase a subscription to that plan.

5.4  You can manage or cancel your subscription, and disable auto-renewal, at any time in your Apple Account settings (Settings › your name › Subscriptions). Deleting the App does not cancel a subscription.

5.5  The lifetime purchase is a one-time, non-consumable in-app purchase granting continued access to the App’s paid features as they exist from time to time. It is not a commitment that any particular feature will always be present: features may be added, changed, replaced, suspended or withdrawn in accordance with Section 19. The lifetime purchase also does not include any separate product, subscription or service that we may offer in the future. Your mandatory rights as a consumer are unaffected.

5.6  Paid plans are not available through Family Sharing. Each person who wants to use the App’s paid features needs their own plan.

5.7  Prices, plans and features may change from time to time; any price change to an existing auto-renewable subscription will be handled in accordance with Apple’s policies, and where required you will be asked to consent to the new price.

5.8  All purchases are final and billing is handled by Apple. Refunds, where available, are provided by Apple in accordance with Apple’s policies; we are not able to process payments or grant refunds directly.

5.9  If a subscription ends, the App returns to its demo mode. Your Content is not deleted: it remains on your devices and in your iCloud, and it is available again in the App if you subscribe again.

6. Your Content and responsibility

As between you and us, you retain all rights in your Content, and you are solely responsible for it, for its legality, and for having the rights necessary to store and share it, including the consent of any person who can be identified in it. The App stores your Content on your devices and in your personal iCloud, and iCloud storage is provided by Apple under Apple’s own terms. THE APP IS A VIEWER AND ORGANISER FOR YOUR 360° PHOTOS AND VIDEOS AND IS NOT A BACKUP, ARCHIVING OR STORAGE SERVICE; YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF ANY CONTENT THAT IS IMPORTANT TO YOU, INCLUDING THE ORIGINAL FILES FROM YOUR CAMERA. We are not responsible for any loss, corruption or unavailability of your Content.

7. Acceptable use

You agree to use the App lawfully and responsibly. You will not use the App:

7.1  in violation of any applicable law or regulation;

7.2  to infringe the intellectual-property, privacy or other rights of any person, including by sharing photos or videos of people without their consent where consent is required;

7.3  to store or share any unlawful, harmful or objectionable material; or

7.4  in any manner that could damage, disable or impair the App or interfere with any other party’s use of it.

8. Shared Albums

8.1  Your choice and responsibility. Sharing an album is optional. When you share an album, iCloud creates a link, and anyone who has that link and is signed in with an Apple Account can view the album’s photos and videos and save copies of them. Links can be forwarded, so you are responsible for choosing whom you send them to and for the Content you share.

8.2  Stopping sharing. You can stop sharing an album at any time, after which its link no longer gives access. We cannot recall copies that people have already saved.

8.3  Albums shared with you. Content in a Shared Album that someone shares with you belongs to them and is their responsibility. Shared Albums are view-only, and you must respect the rights of the person who shared it, including by not redistributing their Content without permission. You may leave a Shared Album at any time.

8.4  No monitoring. We do not see, monitor or moderate Shared Albums or their Content. Sharing depends on iCloud, which is provided by Apple, and may be limited or unavailable where iCloud is.

9. Supported media and viewing

9.1  Supported files. The App is designed for full 360° photos and videos in the standard equirectangular format, which is twice as wide as it is tall. Flat photos, 180° media, 3D VR video and some camera formats may not import, and files from some cameras must first be exported from the camera maker’s own app. We do not guarantee that every file will import, sync or play.

9.2  Device capabilities. How smoothly a photo or video plays, and the highest resolution available, depend on your device, its operating system, available storage and your network connection.

9.3  Viewing safely. Looking around 360° photos and videos, especially by moving your device, can cause discomfort, dizziness or motion sickness in some people. Take breaks, stop if you feel unwell, and stay aware of your surroundings while moving your device.

10. Demo mode and sample content

Before you subscribe, the App may show a demo library of sample 360° videos and fictional albums so you can try it. The sample videos are licensed from their creators, who are credited in the App, and are provided only for evaluating the App. You may not extract, copy or redistribute them. Changes you make in the demo are not saved, and the demo may change or be removed at any time.

11. Third-party services and content

The App relies on and may link to services and content operated by third parties, including Apple’s App Store and iCloud. We do not control and are not responsible for third-party services or content, which are governed by the third parties’ own terms and policies, and your use of them is at your own risk. The App contains no advertising and no third-party analytics or tracking.

12. Intellectual property

The App, and all software, design, text, graphics, names, logos and other materials it contains (excluding your Content and the sample content licensed from third parties), are owned by us or our licensors and are protected by intellectual-property and other laws. Except for the licence expressly granted in these Terms, no rights are granted to you, and we reserve all rights.

13. Feedback

If you send us suggestions, ideas or other feedback about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate that feedback for any purpose, without any obligation or compensation to you.

14. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR FREE OF DATA LOSS, THAT ANY PARTICULAR FILE WILL IMPORT, SYNC OR PLAY, THAT ANY PARTICULAR FEATURE WILL BE AVAILABLE OR REMAIN AVAILABLE, OR THAT THE APP WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR TEN UNITED STATES DOLLARS (US$10). NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, AND SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

17. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend and hold harmless Alper Kaplan from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the App; (b) your Content, including Content you share; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

18. Term and termination

These Terms apply while you use the App. You may terminate them at any time by ceasing to use and deleting the App. We may suspend or terminate your licence immediately if you breach these Terms. Sections that by their nature should survive termination, including Sections 6, 12, 13 and 15 to 23, will survive.

19. Changes to the App, its features and these Terms

19.1  We may add, change, replace, suspend or withdraw features of the App, and may modify, suspend or discontinue the App in whole or in part, where there is a valid reason to do so. Valid reasons include: a change to, or the limitation, withdrawal or unavailability of, a third-party service, platform, device capability or operating-system feature on which a feature depends, including iCloud and other services provided by Apple; the need to keep the App secure, compatible or functioning as operating systems and devices change; the need to comply with law, regulation, or the rules and review requirements of the App Store; and the discontinuation of a feature that is little used or that is no longer technically or commercially viable to maintain.

19.2  Any such change will be made at no additional cost to you.

19.3  Where a change materially and adversely affects your access to or use of a paid feature, we will inform you a reasonable time in advance by a notice in the App, on this page, or in the App Store release notes, and you may stop using the App and cancel any subscription through your Apple Account. Where applicable law gives you a right to terminate the contract, or to a price reduction or refund, in those circumstances, that right is unaffected by these Terms.

19.4  We may also revise these Terms from time to time. The date at the top indicates when they were last revised, and material changes will be posted on this page. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

19.5  Nothing in this Section limits your mandatory rights as a consumer, including any right to a remedy where the App does not conform to what was agreed.

20. Governing law and disputes

These Terms are governed by the laws applicable in the place where the developer is established, without regard to conflict-of-law principles, and subject to any mandatory rights you have as a consumer under the laws of your country of residence. Before bringing any formal claim, you agree to contact us through our support page and to attempt in good faith to resolve the matter informally. The courts of the developer’s place of establishment will have jurisdiction, except where applicable law entitles you to bring proceedings in your own country.

21. Apple App Store additional terms

The following terms apply because the App is licensed through the App Store:

21.1  These Terms are between you and us only, and not with Apple. Apple is not responsible for the App or its content.

21.2  The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

21.3  Apple has no obligation to furnish any maintenance or support services for the App.

21.4  To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation.

21.5  Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.

21.6  Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual-property rights.

21.7  You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

21.8  You must comply with applicable third-party terms of agreement when using the App.

21.9  Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

22. General

22.1  Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the App and supersede any prior agreements.

22.2  Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in effect.

22.3  No waiver. Our failure to enforce any provision is not a waiver of it.

22.4  Assignment. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the App.

22.5  Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.

22.6  Headings. Section headings are for convenience only and do not affect interpretation.

23. Contact
